Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and CareerMarga (“we,” “our,” or “us”), the operator of the CareerMarga platform accessible at career-marga.vercel.app (the “Platform”) and all associated services, features, and applications (collectively, the “Services”).

By creating an account, accessing, browsing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Services.

These Terms apply to all visitors, registered users, and any other person who accesses or uses the Services in any way. We reserve the right to modify these Terms at any time as described in Section 19.

2. Eligibility

To use the Services, you must meet all of the following eligibility requirements:

• You must be at least 13 years of age. If you are between 13 and 18 years of age, you may only use the Services with the express consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
• You must have the legal capacity to enter into a binding contract in your jurisdiction.
• You must not be prohibited from receiving or using the Services under applicable laws, including the laws of your country of residence.
• You must not have had a CareerMarga account previously suspended or terminated for violation of these Terms, unless we have expressly granted you written permission to create a new account.

By accessing or using the Services, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to verify eligibility and deny access to any person who does not meet these requirements.

3. User Accounts

To access certain features of the Services, you must register for a CareerMarga account. You may register using an email address and password, or by using Google Sign-In (“Single Sign-On”).

3.1 Account Registration

When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for updating it promptly when it changes.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password or any Single Sign-On tokens. You agree to notify us immediately at support@careermarga.app upon becoming aware of any unauthorised access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

3.3 Account Responsibility

You are fully responsible and liable for all activities that occur under your account, whether or not authorised by you. You may not share your account credentials with any third party, allow others to access the Services through your account, or transfer your account to any other person.

3.4 One Account Per User

You may maintain only one active account per person. Creating multiple accounts or using automated means to create accounts is a violation of these Terms and may result in the suspension or termination of all associated accounts.

4. Acceptable Use

You agree to use CareerMarga only for lawful purposes and in accordance with these Terms. You must not:

• Use the Services for any unlawful purpose or in violation of any applicable local, national, or international laws or regulations.
• Upload, submit, or transmit any content that is defamatory, obscene, harassing, threatening, discriminatory, or otherwise objectionable.
• Impersonate any person or entity, or falsely represent your identity or affiliation with any person or entity.
• Attempt to gain unauthorised access to any part of the Services, other user accounts, computer systems, or networks connected to the Services.
• Engage in any activity that interferes with, disrupts, or places an unreasonable burden on the Services or the infrastructure supporting the Services.
• Use automated scripts, bots, scrapers, or other automated means to access or interact with the Services without our prior written consent.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Services.
• Use the Services to develop a competing product or service, or to benchmark the Services for competitive purposes without our prior written consent.
• Resell, sublicense, or otherwise make the Services available to any third party without our prior written consent.
• Upload or transmit viruses, malware, or any other malicious code that could harm our systems, other users, or third parties.
• Attempt to circumvent any content filtering, security measures, or access controls implemented by CareerMarga.
• Use the AI features to generate content that violates any third party's rights, including intellectual property rights or privacy rights.

We reserve the right, at our sole discretion, to suspend or terminate your access to the Services for any violation of this Acceptable Use Policy.

5. AI Generated Content Disclaimer

You expressly acknowledge and agree that:

• AI-generated content is provided “as is” for informational and educational purposes only. It does not constitute professional career counselling, recruitment advice, legal advice, or any other form of licensed professional advice.
• AI systems may produce inaccurate, incomplete, outdated, or inappropriate outputs. CareerMarga does not warrant the accuracy, completeness, reliability, or suitability of any AI-generated content.
• AI-generated resume suggestions, interview answers, or career advice should be critically reviewed and adapted by you before use. You are solely responsible for how you use AI-generated outputs.
• CareerMarga is not responsible for any outcomes — including employment decisions, interview results, or career consequences — arising from your use of or reliance on AI-generated content.
• AI content may reflect biases present in training data. We make no representation that AI outputs are free from bias, prejudice, or cultural assumptions.
• You must ensure that any AI-generated content you submit to employers, institutions, or other parties is reviewed for accuracy and is truthful and representative of your own qualifications and experience.

6. Resume Analysis Disclaimer

CareerMarga provides AI-powered resume analysis, ATS (Applicant Tracking System) scoring, and resume optimisation suggestions. You acknowledge and agree that:

• ATS scores and resume analysis results are estimates based on algorithmic analysis and do not guarantee that your resume will pass any specific employer's ATS system or result in interview invitations.
• Different employers and ATS platforms use varying criteria, algorithms, and scoring methods. Our analysis reflects general best practices and may not perfectly align with any specific employer's proprietary system.
• Resume analysis and suggestions are informational in nature. CareerMarga does not guarantee that implementing our suggestions will result in employment, improved interview rates, or any specific career outcome.
• You remain solely responsible for the accuracy, truthfulness, and integrity of the content of your resume. CareerMarga does not verify the accuracy of information contained in uploaded resumes.
• CareerMarga is not liable for any adverse outcomes, including failed job applications or employment decisions, arising from your use of the resume analysis features.

7. Career Advice Disclaimer

The career guidance, coaching responses, learning roadmaps, skill recommendations, and career insights provided through CareerMarga — whether AI-generated or otherwise — are for general informational and educational purposes only.

• CareerMarga's career guidance is not a substitute for advice from a qualified career counsellor, recruiter, industry professional, or other licensed professional.
• Career advice provided through the platform is based on general information available at the time of generation and may not reflect the specific requirements of your industry, geography, employer, or personal circumstances.
• Job market conditions, employer requirements, and industry trends change rapidly. CareerMarga does not guarantee that the information provided is current, complete, or applicable to your specific situation.
• Any decisions you make based on career guidance provided through CareerMarga — including decisions regarding education, employment, or professional development — are made at your sole discretion and risk.
• CareerMarga is not liable for any direct or indirect consequences of career decisions made based on information or guidance obtained through the Services.

8. User Responsibilities

As a user of CareerMarga, you are responsible for:

• Providing accurate, truthful, and non-misleading information in your account profile, uploaded resumes, and all interactions with the platform.
• Ensuring that any content you upload or submit does not infringe the intellectual property rights, privacy rights, or other legal rights of any third party.
• Independently verifying the accuracy and suitability of AI-generated outputs before acting on them or sharing them with third parties, including potential employers.
• Maintaining the security of your account and notifying us immediately of any suspected unauthorised access.
• Complying with all applicable laws and regulations in connection with your use of the Services.
• Respecting the rights and privacy of other users and third parties when using any collaborative or social features of the Services.
• Ensuring that content submitted to or generated by the AI features represents your own genuine qualifications, skills, and experience when used in job applications or professional communications.

9. Intellectual Property

9.1 CareerMarga Intellectual Property

The Services and all content, features, functionality, software, algorithms, designs, graphics, trademarks, trade names, logos, and other materials comprising or forming part of CareerMarga (collectively, the “CareerMarga IP”) are owned by or licensed to us and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial career development purposes, subject to these Terms. This licence does not include the right to:

• Reproduce, distribute, or publicly display any CareerMarga IP
• Modify, create derivative works of, or adapt any CareerMarga IP
• Use any CareerMarga IP for commercial purposes without our express written consent
• Remove, alter, or obscure any copyright, trademark, or proprietary notices

9.2 Feedback

If you provide us with any feedback, suggestions, ideas, or recommendations regarding the Services (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, incorporate, and exploit such Feedback in any manner and for any purpose without obligation or compensation to you.

10. Uploaded Content

10.1 Your Ownership

You retain all ownership rights in and to the content you upload, submit, or otherwise make available through the Services (“User Content”), including your resume files, portfolio materials, and any other documents or data you provide.

10.2 Licence to CareerMarga

By uploading or submitting User Content to the Services, you grant CareerMarga a limited, non-exclusive, worldwide, royalty-free licence to store, process, analyse, and use your User Content solely for the purpose of providing and improving the Services to you. This licence does not permit us to sell, publicly share, or commercialise your User Content beyond the scope of providing the Services.

10.3 Content Representations

You represent and warrant that:

• You have all necessary rights, licences, and permissions to upload the User Content and to grant the licence described above.
• Your User Content does not violate any third party's intellectual property rights, privacy rights, or any applicable law.
• Your User Content does not contain any viruses, malware, or other harmful components.

10.4 Content Responsibility

You are solely responsible for all User Content you upload or submit. CareerMarga does not monitor, review, or verify User Content prior to processing it through our systems. We reserve the right, but have no obligation, to remove any User Content that violates these Terms or applicable law.

11. Payments

Certain features of CareerMarga may in the future require payment of fees (“Paid Features”). The following terms apply to any paid transactions on our platform:

• All fees will be clearly disclosed prior to purchase, including applicable taxes and any recurring charges.
• Payment processing is handled by our third-party payment processors. By making a payment, you agree to the terms of the applicable payment processor.
• All fees are quoted and charged in the currency displayed at checkout and are non-refundable unless otherwise stated in these Terms or required by applicable law.
• We reserve the right to change our pricing at any time. Changes to pricing for existing subscriptions will be communicated with reasonable notice prior to taking effect.
• If your payment method fails or your account becomes past due, we reserve the right to restrict access to Paid Features until payment is received.

Currently, the core features of CareerMarga are offered free of charge. These Terms establish the framework for future paid offerings. We will update this section with specific pricing and payment terms when Paid Features are introduced.

12. Subscription Terms

CareerMarga may offer subscription plans for access to premium features. When subscription plans are introduced, the following terms will apply:

• Billing Cycle: Subscriptions will be billed on a recurring basis (monthly or annually, as selected at purchase) until cancelled.
• Auto-Renewal: Subscriptions will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You authorise us to charge the applicable subscription fee to your designated payment method on each renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at support@careermarga.app. Cancellation takes effect at the end of the current billing period. No refunds will be issued for the unused portion of a subscription period, except where required by applicable law.
• Free Trials: If we offer a free trial period, you must cancel before the trial ends to avoid being charged. Failure to cancel prior to the end of the free trial will result in automatic charges at the applicable subscription rate.
• Downgrades: Downgrading your subscription plan may result in the loss of access to certain features or content.
• Price Changes: We reserve the right to adjust subscription prices with reasonable advance notice. Your continued subscription after the effective date of a price change constitutes your acceptance of the new price.

13. Account Suspension

We reserve the right to suspend your account and access to the Services at any time, with or without prior notice, if we reasonably believe that:

• You have violated or are violating these Terms or our Acceptable Use Policy
• Your account has been used for fraudulent, abusive, or illegal activities
• Your continued access to the Services poses a risk to the security or integrity of our platform or to other users
• You have provided false or misleading information during account registration or use of the Services
• You have failed to pay any amounts owed to us under these Terms
• We are required to do so by applicable law or court order

During a suspension, you will not have access to your account, data, or any CareerMarga services. We may provide notice of suspension via the email address associated with your account, unless notice is prohibited by law or could compromise an investigation. You may appeal a suspension by contacting us at support@careermarga.app.

14. Termination

14.1 Termination by You

You may terminate your account at any time by submitting an account deletion request as described in our Privacy Policy or by contacting us at support@careermarga.app. Termination does not entitle you to a refund of any fees paid.

14.2 Termination by CareerMarga

We may terminate your account and your access to the Services at any time, for any reason, with or without prior notice, including for repeated or severe violations of these Terms. Upon termination for cause, we are not obligated to retain or provide access to your data.

14.3 Effect of Termination

Upon termination of your account, your right to access and use the Services immediately ceases. The following Sections will survive termination of these Terms: Sections 5, 6, 7, 9, 15, 16, and 17. We will handle any data associated with your terminated account in accordance with our Privacy Policy.

14.4 Termination of the Services

We reserve the right to discontinue the Services or any part thereof at any time, with or without notice. We will endeavour to provide reasonable advance notice to registered users in the event of a significant service discontinuation.

15. Limitation of Liability

In no event shall CareerMarga's aggregate liability to you for all claims arising out of or relating to the use of or inability to use the Services exceed the greater of (a) the total amount paid by you to CareerMarga in the twelve (12) months preceding the claim, or (b) one hundred Indian Rupees (INR 100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you in full, and our liability will be limited to the maximum extent permitted by applicable law.

16. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAREERMARGA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY: We do not warrant that the Services are of merchantable quality or fit for any particular purpose.
• FITNESS FOR A PARTICULAR PURPOSE: We do not warrant that the Services will meet your specific requirements or expectations.
• NON-INFRINGEMENT: We do not warrant that the Services will not infringe the rights of third parties.
• ACCURACY AND RELIABILITY: We do not warrant that AI-generated outputs, resume scores, career insights, or any other content provided through the Services are accurate, complete, reliable, current, or error-free.
• UNINTERRUPTED OR ERROR-FREE OPERATION: We do not warrant that the Services will be available without interruption, delay, errors, or omissions, or that defects will be corrected.
• EMPLOYMENT OR CAREER OUTCOMES: We make no warranty or guarantee that use of the Services will result in job offers, employment, career advancement, or any other specific professional outcome.

Any reliance on the Services or the information provided through the Services is at your own risk.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of the Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

17.2 Jurisdiction

You agree that any legal action or proceeding arising from or relating to these Terms or your use of the Services shall be brought exclusively in the courts of competent jurisdiction in India, and you consent to the personal jurisdiction of such courts.

17.3 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact us at support@careermarga.app and make a good-faith effort to resolve the dispute informally. We will respond to your complaint within 30 days of receipt.

17.4 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

• In some circumstances, require your explicit acceptance of the revised Terms before you can continue using the Services

Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Services and may request account deletion as described in our Privacy Policy.
